These Terms and Conditions (“Terms”) govern your use of https://www.cabanajoespoolcare.com and the services provided by Cabana Joe’s Pool Care LLC, doing business as Cabana Joe’s Pool Care & Renovations (“Cabana Joe’s,” “we,” “us,” or “our”). 1. OUR SERVICES
Cabana Joe’s provides residential pool services, which may include weekly pool service, one-time cleanings, acid washes, equipment diagnostics, repairs and installations, pool inspections, and pool renovations and remodeling. Services are available within our service area. Service availability, scope, and pricing are confirmed in your quote, estimate, or service agreement.
2. QUOTES, ESTIMATES, AND PRICING
Prices shared on our website, by phone, or by text message are starting prices or estimates unless stated otherwise. Final pricing may depend on pool size, condition, equipment, debris level, chemical demand, parts, and labor, and may be confirmed after an on-site evaluation. Chemicals are billed separately from weekly service unless your agreement states otherwise. Parts, materials, and repair labor are billed in addition to any diagnostic or service call fee.
3. SCHEDULING AND PROPERTY ACCESS
You agree to provide safe access to your pool and equipment on scheduled service days, including unlocked gates and secured pets. If we cannot access the pool or equipment, or conditions are unsafe, we may need to reschedule the visit. Service days and times may change because of weather, holidays, or other circumstances outside our control.
4. PAYMENT
Payment is due according to the terms stated in your invoice, quote, or service agreement. Pool inspection reports are released after payment is received. We may pause service on accounts with past-due balances.
5. CUSTOMER RESPONSIBILITIES
You are responsible for telling us about known pool, spa, equipment, electrical, or plumbing issues before service begins, and for keeping your pool area safe for our technicians. Between visits, you are responsible for monitoring your pool, including water level, equipment operation, and pool safety barriers.
6. WARRANTIES
Any manufacturer warranties on equipment or parts are provided by the manufacturer. Any workmanship warranty offered by Cabana Joe’s will be stated in writing in your quote or agreement. Except as stated in writing, services are provided without additional warranties to the extent permitted by law.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Cabana Joe’s is not liable for indirect, incidental, or consequential damages, or for damage caused by pre-existing conditions, aging or defective equipment, weather, or circumstances outside our reasonable control. Our total liability for any claim related to a service will not exceed the amount paid for that service.
8. WEBSITE USE
Content on our website is provided for general information and may change without notice. You agree not to misuse the website, attempt to disrupt it, or use it for any unlawful purpose.
9. SMS MESSAGING PROGRAM AND COMMUNICATION CONSENT
